LEGISLATION

This policy is governed by Peruvian law, particularly Law No. 29733 – Personal Data Protection Law, amended by Legislative Decree 1353, Supreme Decree No. 003-2013-JUS, the Regulation of Law No. 29733, and the Information Security Directive, approved by Directoral Resolution No. 019-2013-JUS/DGPDP.

According to Law No. 29733 and its Regulation approved by Supreme Decree No. 003-2013-JUS, personal data is defined as any numerical, alphabetic, graphic, photographic, acoustic, behavioral, or other type of information relating to a natural person that identifies or makes them identifiable through reasonably used means.

Furthermore, Personal Data Processing is understood as any technical operation or procedure, automated or not, that allows the collection, recording, organization, storage, conservation, elaboration, modification, extraction, consultation, use, blocking, deletion, communication by transfer or dissemination, or any other processing method that facilitates access, correlation, or interconnection of personal data.

PRINCIPLES

RLC REPRESENTACIONES QUÍMICAS S.A.C. develops its personal data processing policy in accordance with the guiding principles established in Law No. 29733 – Personal Data Protection Law, amended by Legislative Decree 1353, as follows:

  • Principle of legality: The collection of Users’ personal data through fraudulent, unfair, or illegal means is prohibited.
  • Principle of consent: The processing of Users’ personal data will be based on their consent.

Users’ personal data will be collected for a specific, explicit, and lawful purpose and will not be used for any purpose other than that explicitly established at the time of collection, except in cases of historical, statistical, or scientific activities using anonymization or dissociation procedures.

All processing of Users’ personal data will be adequate, relevant, and not excessive concerning the purpose for which it was collected.

Personal data to be processed will be accurate, true, and, whenever possible, updated, necessary, relevant, and adequate for the purpose for which it was collected. It will be stored in a manner that ensures its security and only for the time necessary to fulfill the purpose of processing.

RLC REPRESENTACIONES QUÍMICAS S.A.C. informs its Users that they may exercise their rights under the constitutional right to personal data protection before the National Data Protection Authority and the Judiciary for the initiation of the corresponding habeas data process.

  • Identification data of individuals or companies (Business Name, RUC) or contact details for various business or informational purposes. This data is requested in the Client Registration Form and stored in our system for sending quotations, collection contacts, invoicing, etc.
  • Financial or asset information when required to monitor contract compliance or evaluate a credit line.

Quality of personal data

  • Personal data requested from Users is basic contact information and is adequate, relevant, and not excessive regarding the purpose for which it is collected.
  • Personal data accessed by RLC REPRESENTACIONES QUÍMICAS S.A.C. will be that which Users voluntarily provide through forms.
  • Users are provided with technical resources to acknowledge this Privacy Policy and relevant information; submitting personal or confidential data constitutes explicit consent to this Privacy Policy.

  • Personal data provided by Users will be treated with full confidentiality, and RLC will maintain professional secrecy indefinitely while taking all necessary security measures.

  • RLC implements technical, legal, and organizational measures to ensure data security, prevent unauthorized access, alteration, loss, or misuse, according to Peruvian law.
  • Additional security measures are in place to reinforce confidentiality and integrity. Users should exercise caution when sharing personal information, as transmission over the internet is not completely secure.

Exercise of rights

  • Users may exercise their rights to access, update, rectify, delete, oppose, or request specific processing of personal data under Peruvian law by submitting a written request at RLC’s main office: Av. Monseñor Roca y Boloña 146, Miraflores, Lima, during office hours (07:30 am – 4:30 pm), using form RLC-REG-SIG-052. Alternative channels may be established and communicated by RLC.

Minors

  • The website is not intended for individuals under 18. RLC will not knowingly process personal data of minors and will take appropriate measures to delete any such data if discovered.
